1.              Introduction

1.1           These terms and conditions (“Terms”) regulate your purchase of the products (“Products”) we promote and sell on the website https://www.aprogroup.co.uk (“Website”).

1.2           Aprogroup.co.uk is operated by APRO Group LTD. We are a limited company registered in England. Our registered company number is GB 10726844 and our registered Office is at Grosvenor House  658 Chester Road, Birmingham B23 5TE. Our VAT registration number is GB 306548504.

1.3           Your purchase of any of the products offered on the Website is subject to these Terms. You should print a copy of these Terms for future reference.

1.4           When you make a purchase on the Website, we ask you to confirm your acceptance of these Terms. If you do not acceptance the Terms please do not use the Website.

4.              Account

4.1           You may register an account on the Website to get access to certain services.

4.2           Registration is free of charge.

4.4           You must supply in process of registration truthful, accurate and complete information.

4.5           You are responsible for all purchases and activities made on your account.

4.6           Please note that we may suspend or terminate your account and your ability to use the Website in any case of breach of this Terms or laws.


5.              Purchase on the Website

5.1           On the Website you may purchase furnitures and mattresses. We only offer new Products.

5.2           You can purchase a Product from us by placing an order on the Website (you may register an account or not) or sending an e-mail to us.

5.3           By placing an order on the Website, you confirm that you are: legally capable of entering into binding contracts; at least 18 year old; resident in the England.

5.4           After placing an order you will receive an email from us acknowledging that we have received your order ("Order Acknowledgement").

5.5           Order Acknowledgement contains full details of the order (such as order No, information of Products, prices, delivery cost, your shipping address and other). Please note that the Order Acknowledgement does not constitute a confirmation that your order has been accepted by us.

5.6           After placing an order you have 3 days to pay for Products. Please note that no Product will be shipped to you until payment has been made in full.

5.7           We will confirm acceptance of the order by sending you an e-mail that confirms that the Product has been shipped to you ("Shipping Confirmation").

5.8           The contract between you and us will only be formed when we send you the Shipping Confirmation ("Contract").

5.9           All orders are subject to acceptance by us. We reserve the right not to accept your order for any reason, for example if:

5.9.1      you provide us with incomplete, incorrect information about your legal status, payments details, shipping address;

5.9.2      we discover an error on the Website relating to the ordered Products;

5.9.3      Ordered Products are out of the stock or no longer available.

5.10       Ordered Products are subject to availability. In case we cannot accept the order we will contact you by email or phone as soon as possible. If you have already paid for order we will refund you the money.


6.              Risk and title

6.1           The Product will be at your risk from the time of delivery.

6.2           Ownership of the Product will pass to you when we will receive the full amount of payment for the Product.


7.              Delivery

7.1           We will deliver the Product to you by the delivery date set out in the Shipping Confirmation. Also in the Shipping Confirmation are specified delivery charges.

7.2           Please note that, we deliver Products only in the United Kingdom.

7.3           Products will be delivered to you by DPD delivery company.


8.              Price and payment

8.1           The price of any Products will be as quoted in the Website in GBP.

8.2           These prices include VAT, but exclude delivery cost.

8.3           Prices may change at any time, but changes will not affect orders for which we have already sent a Shipping Confirmation.

8.4           Payment will be accepted only by PayPal.


9.              Your right to cancel

9.1           Consumer has the right to cancel the Contract within 14 days without giving any reason.

9.2           The right to cancel the Contract will expire after 14 days from the day on which you receipted the Product.

9.3           To exercise the right to cancel you must inform us of your decision to cancel from Contract by statement e.g. a letter send by post:

9.4           After exercising the right to cancel, you must return the Products to us without any undue delay and in any event not later than 14 days from the day on which you notify your cancellation from the Contract to us. The deadline will be met if you send back the Products to us before the below period of 14 days has expired.

9.5           The Product must be returned to us at the address: 20 Washington Drive, Carbrooke, Thetford, Norfolk, IP25 6GY.

9.6           Please note, that you will have to bear the direct cost of returning the Products to us.

9.7           Right of cancellation does not apply in following cases:

9.7.1      the supply of water, gas, electricity or district heating - for which the price is dependent on fluctuations in the financial market which cannot be controlled by the trader and which may occur within the cancellation period;

9.7.2      the supply of goods that are made to the consumer’s specifications or are clearly personalized;

9.7.3      the supply of goods which are liable to deteriorate or expire rapidly;

9.7.4      the supply of alcoholic beverages, where: (i) their price has been agreed at the time of the conclusion of the sales contract, (ii)delivery of them can only take place after 30 days, and (iii)their value is dependent on fluctuations in the market which cannot be controlled by the trader;

9.7.5      contracts where the consumer has specifically requested a visit from the trader for the purpose of carrying out urgent repairs or maintenance;

9.7.6      the supply of a newspaper, periodical or magazine with the exception of subscription contracts for the supply of such publications;

9.7.7      contracts concluded at a public auction;

9.7.8      the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities, if the contract provides for a specific date or period of performance.


10.           Refund policy

10.1       After cancellation of the Contract we will refund all payments received from you, including the cost of delivery (with the exception of additional expenses arising from a decision by the customer to choose a delivery mode other than the least expensive ordinary delivery we offer), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to cancel the Contract.

10.2       The refund will be processed using the same means of payment that you used for the purchase, unless you have expressly agreed otherwise. You will not incur any fees as a result of such reimbursement.

10.3       We have the right to withhold reimbursement until received the Products back or you have supplied evidence of having sent back the Products.


11.           Severability

11.1       If any provision of these Terms are determined to be invalid, unlawful or unenforceable the remainder of these Terms shall continue to be valid and enforceable.


12.           Law and jurisdiction

12.1       Contracts for the purchase of the Products or any other dispute is governed by laws of England and Wales.

12.2       You submit to the non-exclusive jurisdiction of the courts of England and Wales.

12.3       All communications between you and us especially about the Contract for the purchase of the Products will be in English language.


13.           Online dispute resolution platform 

13.1       In case you have a complaint or feel there is a dispute between us, please contact us first. In case the dispute between us is not resolved you may use the Online Dispute Resolution (ODR) platform that can be accessed through http://ec.europa.eu/odr. The ODR platform is free of charge.


14.           Changes

14.1       We reserve the right to change these Terms from time to time by changing them on the Website although such changes will not affect any order you have already placed with us.
